Account Creation

To use certain features of NXTSZN, you must create an account. When creating an account, you agree to:

• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Identity Verification

All sellers must verify their identity before listing items for sale. We may require additional verification for certain transactions or activities. You agree to provide accurate identification documents when requested and understand that we may use third-party services to verify your identity.

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree not to share your account with others or allow anyone else to access your account. If you suspect unauthorized access, contact us immediately.

Listing Requirements

When listing items for sale, you agree to:

• Provide accurate, detailed descriptions of items, including condition, size, and any flaws or damage
• Include clear, accurate photos that show the actual item being sold
• Set fair and reasonable prices
• Specify accurate shipping options and costs
• Respond promptly to buyer questions and messages
• Only list items you legally own and have the right to sell

Seller Obligations

As a seller, you agree to:

• Ship items promptly after payment is confirmed and held in escrow
• Package items securely to prevent damage during shipping
• Provide accurate tracking information as soon as items are shipped
• Ensure items match their listing descriptions and arrive in the condition stated
• Honor all commitments made in your listings
• Cooperate with dispute resolution processes when issues arise

Prohibited Listings

You may not list items that are prohibited by our Prohibited Items Policy or violate our Acceptable Use Policy. We reserve the right to remove any listing that violates these policies or these Terms.

Purchase Process

When you purchase an item on NXTSZN:

• You enter into a contract directly with the seller, not with NXTSZN
• Payment is held securely in escrow until you confirm receipt and satisfaction
• You agree to pay the listed price plus applicable shipping costs
• You are responsible for providing an accurate shipping address

Buyer Obligations

As a buyer, you agree to:

• Complete purchases you commit to making
• Pay promptly when you make a purchase
• Inspect items promptly upon delivery
• Confirm receipt only when items match the listing description and you are satisfied
• Open disputes promptly if there are issues with your purchase
• Communicate respectfully with sellers through our platform

Payment Authorization

By making a purchase, you authorize us to charge your payment method for the full amount of the transaction, including item price, shipping costs, and any applicable fees. Payment is processed securely through our payment processor, Stripe.

Escrow System

NXTSZN uses an escrow system to protect both buyers and sellers. When you make a purchase, your payment is held securely in escrow until:

For the purposes of this platform, 'escrow' refers to NXTSZN's payment hold and release process. NXTSZN is not a bank, trustee, or licensed escrow provider. Payments are processed by Stripe on behalf of NXTSZN and released according to platform rules.

• You confirm that the item arrived as described and you are satisfied, or
• A dispute is resolved in favor of the seller, or
• The review period expires and no dispute has been opened

Funds are only released to sellers after delivery confirmation or successful dispute resolution. This protects buyers from receiving items that don't match descriptions and protects sellers from non-payment.

Payment Processing

All payments are processed securely through Stripe, our payment processor. We do not store your full payment card details. By using our Service, you agree to Stripe's terms and conditions for payment processing.

Refunds

Refunds are processed in accordance with our Returns & Refunds Policy. If a dispute is resolved in your favor, refunds will be issued to your original payment method. Refund processing times may vary depending on your payment method and financial institution.

Opening a Dispute

If you have an issue with a transaction, you can open a dispute through our platform. Disputes can be opened for reasons including:

• Item not as described
• Item damaged during shipping
• Wrong item received
• Item not received
• Item is unsafe or prohibited

Dispute Resolution Process

When a dispute is opened, our support team will review the case, examine evidence from both parties, and work to resolve the issue fairly. Both buyers and sellers are expected to cooperate with the dispute resolution process and provide accurate information.

We aim to resolve disputes as quickly as possible. Resolution may involve refunds, returns, partial refunds, or other remedies depending on the circumstances. Our decisions are based on the evidence provided, our policies, and applicable laws.

Dispute Outcomes

If a dispute is resolved in the buyer's favor, funds may be refunded or a return may be arranged. If resolved in the seller's favor, funds are released to the seller. Our dispute resolution decisions are final, subject to your right to pursue legal remedies as described in the "Dispute Resolution" section below.

NXTSZN's Intellectual Property

The Service, including its design, features, functionality, and content, is owned by NXTSZN and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our written permission.

Your Content

You retain ownership of content you create and submit to NXTSZN, such as listings, photos, and messages. By submitting content, you grant NXTSZN a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and promoting the Service.

Respect for Others' Rights

You agree not to post content that infringes on the intellectual property rights of others. If you believe your intellectual property has been infringed on our platform, please contact us with details of the alleged infringement.

Termination by You

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your access to the Service will be suspended, but you remain responsible for completing any pending transactions and fulfilling your obligations to other users.

Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in prohibited activities, or for any other reason we determine is necessary to protect the Service or other users.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and content, subject to our legal obligations to retain certain information (such as transaction records for tax and legal compliance). Outstanding fees and obligations remain due.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NXTSZN operates, without regard to its conflict of law provisions.

Informal Resolution

Before filing a legal claim, you agree to contact us first to attempt to resolve the dispute informally. We will work with you in good faith to resolve any issues.

Binding Arbitration

If we cannot resolve a dispute informally, you and NXTSZN agree to resolve disputes through binding arbitration rather than in court, except for claims that qualify for small claims court. Arbitration will be conducted by a neutral arbitrator in accordance with applicable arbitration rules.

Class Action Waiver

You agree that disputes will be resolved on an individual basis and waive any right to participate in class actions, collective actions, or representative proceedings.
